Terms & Conditions

1. Privacy Policy | Thrive New York Jiu Jitsu, LLC (hereinafter, “Breathe Jiu Jitsu”) is committed to protecting the privacy of personal information provided by its members. Any personal information provided will not be disclosed to any other organization or person unless there is a legal requirement to do so. Such information will be used solely for marketing and improvement of services. All individuals may be photographed or videotaped while attending services provided by/at the premises of Breathe Jiu Jitsu and give full consent for the content to be used for marketing, advertising, social media, or other purpose related to the promotion of Breathe Jiu Jitsu. To be excluded from media content, please submit the request to info@breathejiujitsu.com.

2. Reproduction of Breathe Jiu Jitsu programs in any form is prohibited. Any person who has instructed/is instructing any martial arts, yoga, or other fitness programs outside of Breathe Jiu Jitsu must identify themselves prior to participating in activities held at the premises of/by Breathe Jiu Jitsu.

3. Types of Memberships | 3a. Monthly Memberships Contracts: Each monthly membership contract (or “contracted membership”) has a commitment period (or “contracted month(s)”) that the member agrees to complete payments for. A valid credit card or ACH must be used to complete payments and is subject to be charged for the contracted months. Payments are due each month on the established billing date and are automatically processed. | 3b. 1 Year Membership Contract: This membership contract requires a full one-time payment due at the time of sign-up/activation. | 3c. Class Packages: Class packages will activate as “class credits” once the first class is used and will be valid only for the length of time as listed. Failure to use any remaining class credits between activation and expiration date will result in a forfeiture of class credits. Refunds will not be given for unused credits. | 3d. Use of Classes: Assigned weekly class credits for limited monthly membership (i.e. memberships that do not include unlimited class participation) can be used any time between each month’s billing date. Failure to use class credits will result in a forfeiture of them for that month. Refunds will not be given for unused credits. (For example, if an individual is currently on a 2x/Week membership contract, he/she will have a total of 8 class credits to use each month during his/her membership.) | 3e. Other Types: 3 Day Trial Periods occur for 3-consecutive days and begin on the first day of attendance; no extensions. Non-Contracted Memberships, Drop-Ins, Private Lessons, Uniform Rentals and Per-Day/Per-Week purchases are non-refundable and non-transferable. | Membership types and packages available as well as membership rates are subject to change. (Rates of existing/executed contracts will not be affected by changes.)

4. Freezing a Contracted Membership | Memberships can be frozen after one month from activation. Freezing of a membership can only be done on a per month basis and absolutely cannot exceed more than 3 months in a year; exceeding 3 months may result in cancellation of a membership and all membership cancellation policies will apply. Please note that the month(s) when an account is frozen is/are not counted toward a commitment period or contracted months. Requests to freeze an account (notification and reason) must be submitted to info@breathejiujitsu.com at least 48 hours before the member’s next billing date to avoid being charged for that billing period; refunds will not be given in the event that the request is sent after the billing date.

5. Membership Cancellation Policies | All memberships are non-refundable, non-transferable and come with a 30-day cancellation notice policy. All requests to cancel a membership (notification and reason) must be submitted to info@breathejiujitsu.com 30 days prior to next billing date) unless otherwise noted in writing by a Breathe Jiu Jitsu owner or manager. Breathe Jiu Jitsu is not required to pro-rate any memberships should the individual fail to provide 30-day cancellation notice. Refunds will not be given if a request to cancel a membership is not submitted within the required time frame and a bill has already been paid. Cancellation policies apply to all membership types unless otherwise noted. | 5a. Cancellations within the first 3 days of activation: Contracted memberships may be cancelled without a cancellation fee or penalty fee within the first 3 days from signing up/activation only. This does not apply to no-contract memberships or packages. The first month will not be refunded and the membership will expire (1) month from activation. (For example, if you signed up on November 25, 2018 and submit a request to cancel your membership before November 28, 2018, the remaining contracted months of your membership will be cancelled. A refund for the first month of membership will not be provided and your membership will remain valid until December 25, 2018.) | 5b. Cancellations before the commitment period is completed: If a contracted membership is requested to be cancelled after the 3-day window has passed and before the commitment period is completed, the individual is subject to a penalty fee due to breach of contract. No exceptions. The penalty fee is equivalent to the price of (1) month of his/her current membership. The fees are due immediately and termination of the membership will occur on the next scheduled billing date. Requests to cancel a membership must be submitted 30 days before the member’s next billing date in order to avoid being charged for that billing period; refunds will not be given if a request to cancel a membership is not submitted within the required time frame and a bill has already been paid. Please note if and individual neglects to comply with the membership agreement, he/she may not be eligible to sign up for another membership agreement for up to 6 months. Breathe Jiu Jitsu reserves the right to deny services, membership agreements, and/or entry for any reason especially due to noncompliance with terms and conditions. | 5c. Cancellations after the commitment period is completed: There will be no cancellation fees or penalty fees charged if (1) the initial commitment period has been/will be fulfilled and (2) the individual who owns the membership provides the required 30-day notice for cancellation. Requests to cancel a membership must be submitted 30 days before the member’s next billing date to avoid being charged for that billing period. Note: Cancellation fees and penalty fees do not apply if the individual needs to cancel or freeze his/her membership due to (1) his/her military deployment or that of his/her legal spouse or (2) PCS or relocation order during his/her status as active duty military personnel or that of his/her legal spouse.

6. Failure to Pay / Delinquent Member Account: Should the credit card on file of a membership be declined, and the member does not provide valid form of payment for his/her membership within 30 days after a bill is past due, Breathe Jiu Jitsu reserves the right to terminate the individual’s membership as well as assign the account to a collection agency. A $15 processing fee will be charged for declined payments, insufficient funds, or return/stop payments.

7. Miscellaneous | Terms, conditions, and prices are subject to change. Breathe Jiu Jitsu reserves the right to terminate any memberships, refuse service, or deny entry at the discretion of a Breathe Jiu Jitsu owner or manager. Breathe Jiu Jitsu is not responsible for lost, damaged, or stolen items.

8. Legacy Membership Status | Automatically applied for all of our members who signed up with us during our first year (11/2018 - 11/2019). No new contracts required for legacy members; memberships continue on month-to-month basis after contract period ends and will not be affected by price increases. Membership options for legacy members have been grandfathered. Prices for legacy members will remain available for as long as he or she is a member at Breathe Jiu Jitsu.

*Changes will only apply when Kids Memberships move to Adult Memberships, but Legacy Membership Status will remain, allowing access to grandfathered Adult Memberships. Legacy Membership status will be cancelled when a membership is cancelled/terminated. Legacy Membership status will remain for any first-year members who request to upgrade to any 12-month tier memberships at any time.
